Terms of Use.

Who we are

Samklang is provided by wieo AB (org. no. 559061-4508), Sturegatan 7b, Malmö, Sweden. These terms and the Privacy Policy are an agreement between you and wieo AB. Using Samklang, Samklang Server or the satellite software means you accept them.

What Samklang is

• Samklang, the app for iPhone, iPad and Mac, from the App Store.
• Samklang Server, free software you run on your own Mac or Raspberry Pi, from this website.
• The satellite software, free software for a Raspberry Pi Pico W, from this website or through Samklang Server.

They work on your own network with speakers and devices made by others. We can't promise that every speaker works, or keeps working when its maker changes it.

The subscription

• Samklang is a subscription, monthly or yearly. The price, with taxes, is shown in the App Store in your currency.
• New subscribers get 7 days free, with every feature. Apple decides who can have the free week: one per Apple Account.
• Apple handles payment: it charges you when the free week ends, and then each month or year. We never see your card.
• The subscription renews until you cancel it. Cancel at least 24 hours before the period ends, in Settings → your name → Subscriptions on your iPhone or iPad, or in the App Store on your Mac. Cancel during the free week and you pay nothing. Cancel later and you keep Samklang until the end of the period you paid for.
• One subscription covers Samklang on your iPhone, iPad and Mac with the same Apple Account.
• Refunds are handled by Apple under its rules, at reportaproblem.apple.com. Your consumer rights are not affected.
• If you live in the EU or the UK: by starting the free week or the subscription you ask for Samklang to start at once, and you give up the 14-day right of withdrawal for the period that has started, as far as the law allows. Apple's rules may still give you a refund.
• If the price changes, Apple tells you in advance, and you can cancel before the new price applies.

Samklang Server and the satellite software

• They are free, for use in your home or your own premises, with Samklang.
• You may install them on as many of your own devices as you like. Don't sell them, or offer them to others as your own.
• You may write your own apps, scripts and integrations that talk to Samklang Server through its published API, and share them, free or paid. Just don't present them as made by us.
• They contain open-source parts, each under its own licence. Nothing in these terms limits what those licences allow.
• Samklang Server checks once a day whether there is a new version, and Samklang tells you. A new version of the satellite software is installed on a satellite only when you approve it in Samklang. Updates are signed by us, and a satellite installs only software we signed.
• If an update over Wi-Fi fails, the satellite keeps the software it had. As a last resort, you can put the software on it again with a USB cable, as in the setup guide.

Using Samklang fairly

• Samklang plays what you play from your own apps. Only play what you have the right to play, and respect the terms of the music services you use.
• Use Samklang on networks and speakers you own or are allowed to use.
• Don't try to get around the subscription, overload our website, or copy, resell or take apart the Samklang app, except as far as the law allows.

Feedback

We're glad to hear ideas. We may use what you suggest to improve Samklang, without owing you anything for it.

Our software

Samklang, Samklang Server, the satellite software, the name Samklang and the icon belong to wieo AB. You get a personal, non-exclusive, non-transferable right to use them as these terms say. AirPlay, Chromecast, Google Cast, Sonos, Raspberry Pi and the other names mentioned belong to their owners; Samklang is not made or endorsed by them.

Ending

• You can stop using Samklang at any time: cancel the subscription, and delete the app, Samklang Server and the satellite software.
• Deleting the app does not cancel the subscription.
• If we stop offering Samklang, we tell you at least 30 days before. What you set up keeps working on your own network as long as it can, but without updates.

The service and liability

• Samklang is provided "as is". It may have errors, and features may change.
• As far as the law allows, we are not liable for indirect losses, for speakers or devices made by others, or for losses caused by your network. Our total liability is limited to what you paid for Samklang in the last 12 months.
• These limits don't apply to intent, gross negligence, or consumer rights that can't be waived.

If you got Samklang from the App Store

• This agreement is between you and wieo AB, not Apple. wieo AB, not Apple, is responsible for Samklang, its content, support, maintenance, and any claims about it, including claims that it infringes someone else's rights.
• Apple has no duty to provide support or maintenance. If Samklang fails to meet a warranty, you may tell Apple, and Apple may refund the purchase price; Apple has no other warranty obligation.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them.
• You confirm that you are not in a country under a US government embargo, and not on a US government list of prohibited or restricted parties.

Changes

We may change these terms. Changes apply when published here, and the date at the top shows the last change. Important changes are announced in Samklang first. If you don't accept a change, cancel your subscription and stop using Samklang.

Law and disputes

Swedish law applies, but you keep the mandatory consumer protection of the country you live in. Contact us first to sort out a disagreement. Consumers may also turn to the Swedish National Board for Consumer Disputes (ARN, arn.se). Disputes are settled by Swedish courts, with Malmö District Court as the first instance.
